Terms of Service
Last updated 17 October 2026
These terms are a binding agreement between you and Rakshit Kumar (“we”, “us”) for your use of ChatAutomater, a tool for automating eligible Instagram, Facebook, WhatsApp, X / Twitter and Telegram interactions through their official APIs. By signing in or using the service you accept these terms, the Privacy Policy, the Acceptable Use Policy and the Cancellation & Refund Policy. If you do not agree, do not use the service.
1. Eligibility and accounts
You must be at least 18 and able to form a binding contract. If you use the service for a business, you confirm you have authority to bind it. Sign-in is through Google; you are responsible for your Google account, for everything done in your workspace, and for keeping provider credentials secure. Give us accurate information and tell us promptly of any unauthorised use.
2. Connecting accounts
You may connect only Instagram, Facebook, WhatsApp, X and Telegram accounts, Pages, numbers or bots that you own or are authorised to manage. You grant us permission to access them via the provider’s API solely to provide the service. You must comply with each provider’s terms and policies, including Meta’s Platform Terms and messaging policies, WhatsApp Business policies, the X Developer Agreement and the Telegram Bot terms. Providers may restrict, suspend or charge for access at any time, and that is outside our control.
3. Your content and your contacts’ data
You keep ownership of your content, messages, rules and the data you collect. You give us a limited licence to host, process and transmit it to operate the service. You are responsible for the lawfulness of your messages and for having any consent, notice or legal basis needed to contact people and to collect their data, including honouring opt-outs (STOP / UNSUBSCRIBE). See the Privacy Policy for how we handle data.
4. Responsible use
You must follow the Acceptable Use Policy. Do not use the service for spam, unsolicited bulk messaging, impersonation, harassment, illegal activity, or to evade provider limits. X automation is limited to requested public mention replies and requires the platform’s approval; X direct messages are not supported. WhatsApp free-form replies require an open customer-service window and template campaigns are not included. We may suspend automations or accounts that breach these rules or put the service or other users at risk.
5. Plans, billing and renewal
Paid plans are billed monthly in Indian rupees (INR) through Razorpay, in advance, and renew automatically until cancelled. The price and allowances are shown before checkout. By subscribing you authorise recurring charges to your chosen payment method. We may change prices or plan allowances with at least 30 days’ notice; a change takes effect at your next renewal, and you may cancel before then. Provider and third-party fees (such as WhatsApp conversation charges or X API costs) are separate and are your responsibility. Cancellation and refunds are governed by the Cancellation & Refund Policy. All fees are non-refundable except as stated in that policy.
6. Availability and changes
We work to keep the service available but do not promise uninterrupted or error-free operation. Delivery depends on provider permissions, eligibility rules, account status, rate limits and outages, and we do not guarantee that any message will be delivered. We may modify, add or remove features, and we will try to give notice of material reductions.
7. Intellectual property
The service, its software, design and branding belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use it in line with these terms. You may not copy, resell, reverse engineer or build a competing product from it, except where the law allows. Third-party names and logos belong to their owners.
8. Independent project
ChatAutomater is independent and is not affiliated with, sponsored or endorsed by ManyChat, Instagram, Facebook, WhatsApp, Meta, Google, X, Telegram or Razorpay.
9. AI-generated replies
If you enable AI replies, responses are generated by third-party models and may be inaccurate or inappropriate. You are responsible for reviewing your configuration and knowledge base and for what is sent in your name. Do not rely on AI replies for legal, medical, financial or safety-critical advice.
10. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or secure operation. Nothing here limits rights you have under law that cannot be excluded.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, or for account restrictions imposed by third-party platforms. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the event giving rise to the claim (or INR 1,000 if you have not paid anything).
12. Indemnity
You will indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your content, your messages or contacts’ data, your breach of these terms or of a provider’s terms, or your violation of law or third-party rights.
13. Suspension and termination
You may stop using the service and delete your workspace at any time in Settings (this first cancels any recurring subscription). We may suspend or terminate access immediately for breach, non-payment, legal requirement or risk to the service. On termination your right to use the service ends; sections that by nature should survive (including ownership, disclaimers, liability and indemnity) will survive. Data is handled as described in the Privacy Policy.
14. Changes to these terms
We may update these terms. We will post the new version here with a new date and give reasonable notice of material changes. Continued use after the effective date means you accept the updated terms.
15. Governing law and disputes
These terms are governed by the laws of Delhi, India. Please contact us first at rkstsuku@gmail.com so we can try to resolve any dispute informally. Failing that, the courts of Delhi, India have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
16. General
These terms are the entire agreement on this subject. If a provision is unenforceable the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a business transfer. We are not liable for delays caused by events outside our reasonable control.
